Finishing a basement legalization another contractor left behind

A homeowner hired another contractor to legalize their basement, but the contractor left before completing the work.

When we took over, we found a missing clean-out. The basement could not pass its plumbing inspection without one, so we had to remove a section of the finished flooring to install it.

We also removed all the drywall to install a vapour barrier throughout, corrected the plumbing rough-ins and upgraded the electrical panel.

Finished surfaces do not mean a basement is ready to pass inspection. We plan each stage so the inspector can see the work that needs approval.

A separate entrance, or shared access

For a side or rear entrance, you need a clear 1.2 metre path on your property. Access through a garage or shared interior vestibule is also permitted.

An above-grade entrance usually costs about $2,000 to $3,000. A walkout that needs excavation below ground level costs more.

Egress windows in the bedrooms

Each bedroom needs a window with a clear opening of at least 0.35 square metres and no side smaller than 380 mm, unless that level has an exterior door.

Fire separation between the units

Fire separation requirements apply to the ceiling between units, beneath the stairs and around the furnace room. The furnace room usually also needs sprinklers.

Electrical panel upgrade (usually 100A to 200A)

Another kitchen, laundry area and heating load increase electrical demand. The legal basement projects we have worked on have needed a 200 amp service upgrade.

Plumbing and venting that pass inspection

Inspectors check underground plumbing before the floor is closed. The drain line needs a clean-out, and vent pipes must be the correct size and type. In most locations, the city requires 6-inch hard pipe.

Size and registration

The basement apartment must be smaller than the main dwelling. After passing inspection, it is registered with the city as an Additional Residential Unit.

Brampton basement inspections: what happens at each stage

The city checks a legal basement at several stages, following its mandatory inspection schedule. Book through Brampton's Building and Business Portal at least five business days ahead, with someone on site between 8am and 4pm. The city's inspection booking guidance also explains recall fees: since July 21, 2025, an ARU inspection that fails twice incurs a fee. Electrical work is inspected separately by the Electrical Safety Authority.

When is underground basement plumbing inspected?

The inspector checks drains beneath the slab before they are covered with concrete.

Can I close the walls before the rough-in inspection?

Once plumbing and HVAC rough-ins are installed, they are inspected before the walls are closed.

When are framing and fire separation inspected?

After the rough-ins pass, the city inspects structural framing. Fire separation is usually checked during the same visit.

Does insulation need an inspection before drywall?

This check follows approval of the framing and takes place before drywall installation.

Are the final building, plumbing and HVAC inspections booked together?

Book the final building, plumbing and HVAC inspections together for the same day.

Registering and licensing your completed basement apartment

Passing the final inspections leads to registration as an Additional Residential Unit, which you can check on the city's registered units map. Registration and a rental licence are separate steps. Since January 1, 2026, the licensing requirement applies across every Brampton ward.

How is my basement apartment registered after inspection?

After inspections pass, the city registers the apartment as an Additional Residential Unit and adds it to the registered units map.

Do I need a rental licence once the unit is built?

Yes, if you rent the unit. Since January 1, 2026, a Residential Rental Licence is required for rental properties with one to four units throughout Brampton.

What paperwork should I keep for my legal basement?

Store the permit, inspection records and registration together. Insurers, lenders and future buyers may ask to see them.

Not always. Brampton permits a side or rear entrance with a clear 1.2 metre path. Access through the garage or a shared interior vestibule is also allowed.
